Terms of Service

These Terms of Service ("Terms") govern access to and use of the AI Chat Widget service ("the Service"), provided by Muhammet Karakas ("we", "us"). By signing up for or installing the Service, the real estate agency or business ("Customer", "you") agrees to these Terms.

1. The Service

The Service is an embeddable AI-powered chat widget that Customers install on their own website. It converses with website Visitors, asks qualifying questions (e.g. buying/selling/renting, budget, neighborhood), and forwards captured leads to the Customer by email and/or a dashboard.

2. Subscription and payment

The Service is offered on a monthly subscription, per website, at the price listed on our pricing page at the time you sign up. Pricing is locked in for the life of your subscription unless you are notified of a change in advance. Payment terms and billing method are agreed individually with each Customer at onboarding until self-serve billing is available.

3. Cancellation

There is no long-term contract beyond the initial minimum term stated at signup. A Customer may cancel at any time by notifying us at mamikaramk08@gmail.com; the widget will be deactivated for that Customer's tenantId at the end of the current billing period.

4. Acceptable use

The Customer agrees not to use the Service to:

• Collect information from Visitors under false pretenses, or misrepresent that the chat is a human agent when directly asked.
• Send unlawful, discriminatory, or misleading content through the widget's configuration (e.g. agency name, blurb).
• Attempt to circumvent rate limits, reverse-engineer the backend, or use the Service outside the tenant allowlist provided to them.

5. AI-generated content

Chat replies and inbox reply drafts are generated by a third-party AI model (Google Gemini) and may occasionally be inaccurate, incomplete, or out of date (e.g. pricing, availability, or listing details the AI is not aware of). The Customer is responsible for verifying any information a Visitor relies on before treating it as final, and for reviewing drafted replies before they go out.

6. Data ownership

Leads captured through a Customer's widget instance (names, contact details, conversation summaries) belong to that Customer. We act as a processor of that data on the Customer's behalf, as described in our Privacy Policy.

7. Service availability

We aim for high uptime but do not guarantee the Service will be uninterrupted or error-free. The Service depends on third-party providers (Google Gemini, Resend, Cloudflare); outages on their end may affect the widget.

8. Warranty disclaimer and limitation of liability

The Service is provided "as is" without warranties of any kind. To the fullest extent permitted by law, Muhammet Karakas is not liable for indirect, incidental, or consequential damages arising from use of the Service, including lost leads, lost revenue, or inaccurate AI responses. Our total liability for any claim is limited to the fees paid by the Customer in the 3 months preceding the claim.

9. Changes to these Terms

We may update these Terms from time to time. Material changes will be reflected by updating the "Last updated" date above, and active Customers will be notified by email.

10. Governing law

These Terms are governed by the laws of Turkey, without regard to conflict-of-law principles.
